I was wondering if anyone knew where I can find the state laws and regulations for the great state of Texas. I have been told by a few people that you are only required to have insurance in the state of Texas for amusement park rides. I undestand that for protection I need insurance but since this will be my first year and I am saving up for a wedding I really do not have the income to pay 3-4 thousand dollars for insurance when I am not even sure I will bring that much in the first year. I have already had about 7 rentals but they have all been family and friends so I figured I should find out before I get myself into trouble.

P.S. I have not been posting much since I have been in this forum but I have been reading a lot of the other posts people have been submitting and I have to say I really enjoy everyones input/comments/questions/jokes.

Welcome!
Insurance should be thought of as part of your start-up costs. It's just part of the price we pay to have a inflatable business. We looked into insurance before we bought our first unit and that information even helped us decide how many units we could buy. Not having insurance could cost you everything.

Thanks to Ken for the list. I used it to call a state that I had not worked in to be sure I meet the requirments and I do. I will now be able to market large jobs there as I have had requests.

If it is already listed somewhere here I apologize. Was wondering if anyone knew if a rental inflatable company in New York or New Jersey needs to register with someone, or something. I know that New Jersey has stricter requirements regarding Vinyl materials and when I purchase mine I made sure they met the requirements. Yes in the state of NJ you have to register each inflatable ride. You also have to fax them a list of your rentals everytime you rent an item out. Its really a pain in the butt to do. Yes there is a registration fee. Its &#036;200.00 for each inflatable you have, you must have insurance and it gets inspected by the state at least once a year.

The reason they want an Itenenary of your rentals is so they can do an inspection. I have never had them do an inspection on a private backyard party. However, for a school event they did show up once on me.

Not sure where you are located, but if your delivery area covers North Carolina, it's a different story.

For the first time, the state is not relying on its own inspectors to check out potentially dangerous amusement rides at street fairs and county carnivals.

The Division of Labor, trying to cut costs and keep up with an increasing number of such events, has privatized its inspection business.

It now depends on nine mostly out-of-state private contractors to make sure merry-go-rounds, roller coasters, water rides and other similar attractions are safe and up to state code.

A small group of state inspectors still travels the state, but now it's mostly to provide general oversight of the program and to keep in touch with the particular vendors who set up shop in West Virginia, mostly in the warm summer months.

The job of moving from ride to ride and making sure all the nuts and bolts are in working order has been left to companies specializing in such tasks.

"The inspections take up so much time, and we just didn't have staff available to get them all done," said Jennifer Burgess, director of the safety sector for the state Division of Labor. "Even when we had five inspectors, it was difficult for them to be everywhere they needed to be."

The state estimates it needs to inspect the rides and attractions at about 700 sites each year, from the West Virginia State Fair and the Charleston Sternwheel Regatta to the merry-go-round at the Huntington Mall and the children's ball pens at various entertainment venues.

Burgess said her division couldn't provide any information right now about how much money it costs to operate the amusement sector or how much money the state is saving by phasing out its own inspections. She said staff size has been reduced by about 80 percent, but other costs, including fuel and transportation, have increased dramatically.

The number of inspections also has increased rapidly in the past few years as one particular attraction becomes more and more popular in the state. Referred to as ‘bounces' by those in the business, the giant inflatable playhouses that allow children to bounce up and down are becoming more common at shopping centers, ballparks and even private birthday parties.

"We were having trouble just keeping up with those," Burgess said. "There are more and more of them all the time because they're relatively affordable, they're portable and you can use them outdoors and indoors."

The state's former crew of five amusement inspectors -- which increased from one lone inspector back in the 1980s -- had been trying to keep up with their carnival and fair duties for the past several years while doing double-duty as the state's elevator inspectors.

The responsibility for checking out the more than 4,000 public elevators in the state also was handed off to private companies last year. The state's crew of inspectors then was reduced through attrition from five full-time workers to one full-time worker and two part-time workers.

Transferring the amusement inspections to private contractors was put off until this January to avoid doing such a transition last July at the height of carnival and fair season.

The state has maintained responsibility for keeping track of what events take place and seeing that all vendors have adequate insurance and that they're getting qualified and approved contractors to perform inspections.

"It's gone a lot more smoothly this year, and one of the benefits has been that it frees us up to move around the state and really oversee the performance at a lot of these festivals," Burgess said. "Our people can get out there now, watch what's going on and really get to know who's where and doing what."

Even a private event like the annual Massey Energy Picnic used to zap the state's inspection crew of days of work time. That event usually requires up-close inspections of more than 60 separate rides and events.

Burgess said the state hasn't had a single serious injury on an amusement ride in recent years, and no injuries -- not even a scrape or bump -- has been reported so far this summer.

Festival and fair organizers and amusement venue managers are required to report injuries to the Division of Labor if they require hospitalization or if they result in a victim losing consciousness.



Not quite sure I like this... we are paying more and more and getting less and less services from our state.

In the past 5 years permit fees have went from 25.00 to 100.00 plus they have added a 100.00 inspection fee per ride. With this new plan.. we pay 100.00 per sticker and any fee the outside inspectors want to charge.

This year alone i paid 8000.00 to get up and running ontop of the insurance charges.

How are you doing? thank you for your help, i neede a little more help, i&#96;m in texas and i&#96;m learning that new jersey has very strick laws concerning there moonwalk rentals, i would like to learn all of there laws so i can run my own moonwalk business that way . can you help me find the info that i need? also when a moonwalk rental company has hired employees. is there a manual to teach them all the things they will need to know about moonwalk set up, take down, running the popcorn machines, coton candy machine, ect, if there is will you help me get one, i&#96;m having a real hard time trying to put everything in to words on paper for them. i feel like a nagging mom (lol)
